The Course may reference or link to third-party websites, tools, or services. We are not responsible for the content, accuracy, or practices of any third-party sites. Your use of third-party services is subject to their own terms and policies. We encourage you to review the terms and privacy policies of any third-party service before using it.
Informal resolution first: Before filing any formal dispute, you agree to contact us at support@digitalatmapp.com and attempt to resolve the dispute informally for at least 30 days.
Binding arbitration:If the dispute is not resolved informally, you and Digital ATM agree to resolve any dispute, claim, or controversy arising out of or relating to these Terms or the Course through binding individual arbitration administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules. The arbitration shall be conducted in the State of Wyoming, unless otherwise agreed. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Arbitration fees:Filing fees shall be handled in accordance with the AAA Consumer Arbitration Rules, including the requirement that the business pay all arbitrator compensation and administrative fees beyond the consumer's initial filing fee. Each party shall bear its own attorney's fees unless the arbitrator determines that a party's claim or defense was frivolous, in which case the arbitrator may award reasonable attorney's fees to the prevailing party.
Opt-out: You may opt out of this arbitration agreement by sending written notice to support@digitalatmapp.com within 30 days of your purchase date with the subject line "Arbitration Opt-Out." If you opt out, all other provisions of these Terms remain in effect, and any disputes will be resolved in the courts specified in this section.
CLASS ACTION WAIVER: YOU AND DIGITAL ATM AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. THE ARBITRATOR MAY NOT CONSOLIDATE MORE THAN ONE PERSON'S CLAIMS AND MAY NOT PRESIDE OVER ANY FORM OF CLASS OR REPRESENTATIVE PROCEEDING.
Small claims exception:Notwithstanding the above, either party may bring an individual action in small claims court for disputes within that court's jurisdictional limits.
Injunctive relief exception: Nothing in this section prevents either party from seeking injunctive or other equitable relief in a court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
Governing law: These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, without regard to its conflict of laws provisions. To the extent any claim is not subject to arbitration, the exclusive jurisdiction shall be the state and federal courts located in Wyoming.
Neither party shall be liable for any failure or delay in performance resulting from causes beyond reasonable control, including but not limited to acts of God, natural disasters, pandemics, war, terrorism, government actions, power failures, internet or hosting outages, cyberattacks, or third-party service provider failures. In such events, the affected party's obligations shall be suspended for the duration of the force majeure event.
We are committed to making our Course accessible to all users. If you experience any accessibility barriers while using our platform, please contact us at support@digitalatmapp.com and we will work to address the issue.
The Course is operated from the United States. If you access the Course from outside the United States, you do so at your own initiative and are responsible for compliance with local laws to the extent they apply. By using the Course, you consent to the transfer of your information to the United States as described in our Privacy Policy.
If you are located in the European Economic Area, United Kingdom, or Switzerland, your additional rights under GDPR are described in our Privacy Policy, Section 12. Nothing in these Terms affects your statutory rights under applicable consumer protection laws in your jurisdiction that cannot be waived by contract. If you are a consumer in the European Economic Area, you have a statutory right to withdraw from this purchase within 14 days without giving a reason. Our 30-day refund policy (Section 4) exceeds this statutory minimum.
We may update these Terms from time to time. When we do, we will update the "Last updated" date at the top of this page and, for material changes, we will make reasonable efforts to notify you (such as by posting a notice on our website or sending an email to the address associated with your purchase). Continued use of the Course after changes are posted constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you should stop using the Course.
If any provision of these Terms is held to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be modified to the minimum extent necessary to make it enforceable, or if modification is not possible, severed from these Terms. The remaining provisions shall continue in full force and effect.
Our failure to enforce any right or provision of these Terms shall not be considered a waiver of that right or provision. Any waiver of any provision of these Terms will be effective only if in writing and signed by Digital ATM.
You may not assign or transfer these Terms or your rights under them without our prior written consent. We may assign these Terms in connection with a merger, acquisition, reorganization, or sale of all or substantially all of our assets, provided the assignee agrees to honor these Terms. Any attempted assignment in violation of this section is void.
By purchasing the Course, you consent to receive communications from us electronically, including emails and notices posted on our website. You agree that all agreements, notices, disclosures, and other communications we provide electronically satisfy any legal requirement that such communications be in writing.
Sections 3 (Intellectual Property), 5 (No Guaranteed Results), 6 (Disclaimer of Warranties), 7 (Limitation of Liability), 11 (Dispute Resolution), 16 (Severability), and 21 (Entire Agreement) shall survive any termination or expiration of these Terms.
These Terms, together with our Privacy Policy and Earnings Disclaimer, constitute the entire agreement between you and Digital ATM regarding the Course and supersede all prior or contemporaneous communications, proposals, and representations, whether oral or written, regarding the Course. No representation, promise, or inducement not contained herein shall be binding on either party.
